A BILL TO BE ENTITLED
 
AN ACT
  relating to notification to the county judge and county emergency
  responders of the transportation of certain radioactive waste in
  the county.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 401.052, Health and Safety Code, is
  amended by adding Subsection (a-1) to read as follows:
         (a-1)  Rules adopted under Subsection (a) must require a
  transporter of radioactive material for which hazardous materials
  transportation placarding is required under 49 C.F.R. Part 172 to
  notify the county judge and the appropriate emergency responders of
  each county through which the material will pass. Notice under this
  subsection must be given not less than four days before the arrival
  of the waste in the county.
         SECTION 2.  This Act takes effect September 1, 2013.
