BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. The heading to Section 43.032, Local Government | ||
Code, is amended to read as follows: | ||
Sec. 43.032. AUTHORITY OF CERTAIN [ |
||
MUNICIPALITIES TO ANNEX AN AREA ON [ |
||
SECTION 2. Section 43.032(a), Local Government Code, is | ||
amended to read as follows: | ||
(a) The governing body of a general-law municipality with a | ||
population of 1,500 to 5,000 [ |
||
(1) that is adjacent to the annexing municipality; | ||
(2) that is not being served with water or sewer | ||
service from a governmental entity; and | ||
(3) for which a petition requesting annexation has | ||
been filed with the municipality. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2017. |
