A BILL TO BE ENTITLED
 
AN ACT
  relating to the selection of entities to perform functions required
  of the State Center for Early Childhood Development.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter E, Chapter 29, Education Code, is
  amended by adding Section 29.163 to read as follows:
         Sec. 29.163.  DELIVERY OF CERTAIN EARLY CHILDHOOD
  DEVELOPMENT SERVICES; REFERENCES IN LAW TO STATE CENTER FOR EARLY
  CHILDHOOD DEVELOPMENT. (a) Notwithstanding any other provision of
  this code, the agency, for any function required by this code to be
  performed by or in coordination with the State Center for Early
  Childhood Development, shall solicit proposals from the center and
  other entities to perform the particular function.
         (b)  Based on the proposals received under Subsection (a),
  the agency shall select the State Center for Early Childhood
  Development or another appropriate entity to perform the function. 
         (c)  In selecting an appropriate entity under Subsection
  (b), the agency shall consider:
               (1)  the ability of the entity to expand performance of
  the function on a statewide basis; and
               (2)  the potential for the arrangement with the entity
  to result in donation of revenue to the state for purposes of early
  childhood development programs.
         (d)  A reference in law to the State Center for Early
  Childhood Development with respect to a particular function of the
  center means the center or the entity selected by the agency under
  Subsection (b) to perform that function.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2015.
