relating to prohibiting the pre-adjudication solitary confinement | ||
of certain juveniles. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 51.12, Family Code, is amended by adding | ||
Subsection (n) to read as follows: | ||
(n) Except as otherwise provided by this subsection, a child | ||
may not be detained in solitary confinement. A child may be | ||
detained in solitary confinement only if the solitary confinement | ||
is necessary to: | ||
(1) ensure the physical or mental health or safety of | ||
the child or another child detained in the same facility as the | ||
child; or | ||
(2) comply with the requirements of Subsection (f), | ||
(g), or (l). | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2011. |
