A BILL TO BE ENTITLED
AN ACT
relating to certain land use regulations for land annexed by a
municipality for limited purposes.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter F, Chapter 43, Local Government Code,
is amended by adding Section 43.1305 to read as follows:
Sec. 43.1305. EFFECT OF ANNEXATION ON LAND USE REGULATION.
(a) A municipality may not enforce an ordinance or rule that
limits the number of people who may assemble on property located in
an area that the municipality annexed for limited purposes if the
ordinance or rule would restrict the number of people authorized to
assemble on the property to less than what the fire prevention
authority with jurisdiction over the property has authorized by
permit.
(b) In this section, "fire prevention authority" means a
county fire marshal, a municipal fire department, an emergency
services district, or any local agency that provides emergency
medical services to the area.
SECTION 2. This Act takes effect September 1, 2015.
