| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter C, Chapter 39, Education Code, is | ||
| amended by adding Section 39.0551 to read as follows: | ||
| Sec. 39.0551. CERTAIN STUDENTS PARTICIPATING IN REGIONAL | ||
| DAY SCHOOL PROGRAMS FOR THE DEAF NOT CONSIDERED FOR ACCOUNTABILITY | ||
| PURPOSES. Notwithstanding any other provision of this code, in | ||
| determining the performance of a school district or campus under | ||
| this chapter, a student participating in a regional day school | ||
| program for the deaf under Subchapter D, Chapter 30, whose parent or | ||
| person standing in parental relation to the student does not reside | ||
| in the school district providing program services is not considered | ||
| a student of the district or campus in which the program is | ||
| physically located. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2017. | ||
