A BILL TO BE ENTITLED
 
AN ACT
  relating to prohibited billing practices by certain health care
  providers.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Sections 311.0025(a) and (b), Health and Safety
  Code, are amended to read as follows:
         (a)  A hospital, treatment facility, mental health facility,
  or health care professional may not:
               (1)  flagrantly overcharge a patient or third party
  payor for a treatment provided to the patient; or
               (2)  submit to a patient or a third party payor a bill
  for a treatment that the hospital, facility, or professional knows
  was not provided or knows was improper, unreasonable, or medically
  or clinically unnecessary.
         (b)  If the appropriate licensing agency receives a
  complaint alleging a violation of Subsection (a)(2) [(a)], the
  agency may audit the billings and patient records of the hospital,
  treatment facility, mental health facility, or health care
  professional.
         SECTION 2.  This Act takes effect September 1, 2021.
