| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Sections 311.0025(a) and (b), Health and Safety | ||
| Code, are amended to read as follows: | ||
| (a) A hospital, treatment facility, mental health facility, | ||
| or health care professional may not: | ||
| (1) flagrantly overcharge a patient or third party | ||
| payor for a treatment provided to the patient; or | ||
| (2) submit to a patient or a third party payor a bill | ||
| for a treatment that the hospital, facility, or professional knows | ||
| was not provided or knows was improper, unreasonable, or medically | ||
| or clinically unnecessary. | ||
| (b) If the appropriate licensing agency receives a | ||
| complaint alleging a violation of Subsection (a)(2) [ |
||
| agency may audit the billings and patient records of the hospital, | ||
| treatment facility, mental health facility, or health care | ||
| professional. | ||
| SECTION 2. This Act takes effect September 1, 2021. | ||
