relating to the prescription of a controlled substance for certain | ||
patients and continued treatment of those patients. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter C, Chapter 481, Health and Safety | ||
Code, is amended by adding Section 481.0725 to read as follows: | ||
Sec. 481.0725. PRESCRIPTION OF CONTROLLED SUBSTANCE AND | ||
CONTINUED TREATMENT OF PATIENT AFTER DRUG TEST. A practitioner may | ||
not refuse to prescribe a controlled substance for the treatment of | ||
pain to a patient or refuse to continue treating the patient solely | ||
because the results of a drug test taken by the patient indicated | ||
that tetrahydrocannabinol or cannabidiol was present in the | ||
patient's body. | ||
SECTION 2. The change in law made by this Act applies only | ||
to a prescription issued on or after the effective date of this Act. | ||
A prescription issued before the effective date of this Act is | ||
governed by the law in effect on the date the prescription is | ||
issued, and the former law is continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2023. |
