relating to the compilation and reporting of statistics involving | ||
sexual assault victims who receive a forensic medical examination | ||
before reporting the assault to law enforcement. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 56, Code of Criminal | ||
Procedure, is amended by adding Article 56.0651 to read as follows: | ||
Art. 56.0651. DELAYED REPORTING BY SEXUAL ASSAULT VICTIMS; | ||
COMPILATION OF STATISTICS. (a) In this article, "department" | ||
means the Department of Public Safety. | ||
(b) The department shall compile and maintain statistics on | ||
the number of victims of sexual assault in each calendar year who | ||
have reported the sexual assault to a law enforcement agency after | ||
receiving a forensic medical examination under Article 56.065, | ||
regardless of the year in which that examination was performed. | ||
Statistics compiled and maintained under this subsection may not | ||
include identifying information of a victim. | ||
(c) Not later than September 1 of each even-numbered year, | ||
the department shall: | ||
(1) report the statistics compiled by the department | ||
under Subsection (b) to the standing committees of the house of | ||
representatives and senate with primary jurisdiction over criminal | ||
justice issues; and | ||
(2) post the statistics compiled by the department | ||
under Subsection (b) on the department's Internet website. | ||
SECTION 2. This Act takes effect September 1, 2019. |
