| in certain comprehensive development agreements with the Texas | ||
| Department of Transportation. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 223.208, Transportation Code, is amended | ||
| by adding Subsection (i) to read as follows: | ||
| (i) Sections 228.0545, 228.0546, and 228.0547 do not apply | ||
| to toll collection by a private participant or subcontractor under | ||
| a comprehensive development agreement for a toll project located in | ||
| a county with a population of 3.3 million or more if the agreement | ||
| was | ||
| entered into before September 1, 2017. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2019. | ||
