relating to restoration of the position of public employees when | ||
relieved of duty from the Texas military forces or a similar unit. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 437.202(d), Government Code, is amended | ||
to read as follows: | ||
(d) An employee of this state or a municipality, a county, | ||
or another political subdivision of this state with at least five | ||
full-time employees | ||

military forces, a reserve component of the armed forces, or a | ||
member of a state or federally authorized urban search and rescue | ||
team and who is ordered to duty by proper authority is entitled, | ||
when relieved from duty, to be restored to the position that the | ||
employee held when ordered to duty. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2017. |
