| at health care institutions. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter A, Chapter 74, Civil Practice and | ||
| Remedies Code, is amended by adding Section 74.005 to read as | ||
| follows: | ||
| Sec. 74.005. NOTICE BY PUBLIC INSTITUTIONS. Before a | ||
| health care institution that is owned or operated by the state or a | ||
| political subdivision of the state, including a hospital district, | ||
| provides health care or medical care to an individual, other than | ||
| emergency medical care, the institution must provide a written | ||
| notice to the individual that discloses: | ||
| (1) the liability limits applicable to a health care | ||
| liability claim against the institution under Chapter 101; | ||
| (2) the liability limits that would be applicable to a | ||
| health care liability claim against a private institution under | ||
| this chapter; and | ||
| (3) whether a physician or health care provider who | ||
| will be providing health care or medical care to the individual is | ||
| covered by malpractice insurance or another form of financial | ||
| responsibility described by Section 74.302(e) and the amounts of | ||
| that financial responsibility, if any. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to health care or medical care provided on or after the effective | ||
| date of this Act. | ||
| SECTION 3. This Act takes effect September 1, 2011. | ||
