relating to a voter's use of an application for a ballot to be voted | ||
by mail to update the voter's residence. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 84.002, Election Code, is amended by | ||
adding Subsection (c) to read as follows: | ||
(c) An application for a ballot to be voted by mail may | ||
indicate a change of residence address. If the voter includes a | ||
change of residence address in the voter's application, the early | ||
voting clerk shall notify the appropriate voter registrars of the | ||
change and the registrars shall update the voter's voter | ||
registration information accordingly. | ||
SECTION 2. Section 84.011, Election Code, is amended by | ||
adding Subsection (c) to read as follows: | ||
(c) The officially prescribed application form for an early | ||
voting ballot to be voted by mail must include a space for the voter | ||
to provide a change of residence address. | ||
SECTION 3. Section 86.001(e), Election Code, is amended to | ||
read as follows: | ||
(e) If the applicant does not have an effective voter | ||
registration for the election, the clerk shall reject the | ||
application unless: | ||
(1) the clerk can determine from the voter registrar | ||
that the applicant has submitted a voter registration application | ||
and the registration will be effective on election day; or | ||
(2) the voter has provided a change of residence | ||
address on the voter's application for a ballot to be voted by mail | ||
and the voter's registration will be effective on election day. | ||
SECTION 4. This Act takes effect September 1, 2017. |
