A BILL TO BE ENTITLED
AN ACT
relating to voting methods in a property owners' association
election or vote.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 209.00592, Property Code, is amended by
adding Subsection (a-1) to read as follows:
(a-1) Notwithstanding Subsection (a), and except as
provided by this subsection, a property owners' association is not
required to provide an owner with a voting method that is not
required by a dedicatory instrument. The association must allow an
owner to vote by absentee ballot or by proxy in any vote or election
in which a vote may be cast or given in person.
SECTION 2. This Act takes effect September 1, 2015.
