relating to authorizing certain political subdivisions to change | ||
the date on which the general election for officers is held. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 41.0052, Election Code, is amended by | ||
adding Subsections (a-1) and (a-2) to read as follows: | ||
(a-1) The governing body of a political subdivision, other | ||
than a county or municipal utility district, that holds its general | ||
election for officers on the November uniform election date may, | ||
not later than December 31, 2024, change the date on which it holds | ||
its general election for officers to the May uniform election date. | ||
(a-2) Subsection (a-1) applies only to a municipality: | ||
(1) with a population of more than 30,000; | ||
(2) through which State Highway 121 runs; and | ||
(3) that is wholly located in a county with a | ||
population of more than 500,000 that borders two counties, each of | ||
which has a population of more than 2 million. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2023. |
