relating to the creation of an offense prohibiting advertisements | ||
on an Internet website of certain prostitution offenses. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 43, Penal Code, is amended | ||
by adding Section 43.07 to read as follows: | ||
Sec. 43.07. ADVERTISEMENT OF PROSTITUTION. (a) A person | ||
commits an offense if on an Internet website that is owned or | ||
operated by the person the person publishes or distributes an | ||
advertisement that contains an offer to engage in sexual conduct in | ||
return for receipt of a fee, knowing that the conduct is to be | ||
provided or performed by a victim of an offense under Chapter 20A. | ||
(b) An offense under this section is a state jail felony, | ||
unless it is shown on the trial of the offense that the defendant | ||
has been previously convicted of an offense under this section, in | ||
which event the offense is a felony of the third degree. | ||
SECTION 2. This Act takes effect September 1, 2017. |
