| relating to the creation of an offense prohibiting advertisements | ||
| on an Internet website of certain prostitution offenses. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter A, Chapter 43, Penal Code, is amended | ||
| by adding Section 43.07 to read as follows: | ||
| Sec. 43.07. ADVERTISEMENT OF PROSTITUTION. (a) A person | ||
| commits an offense if on an Internet website that is owned or | ||
| operated by the person the person publishes or distributes an | ||
| advertisement that contains an offer to engage in sexual conduct in | ||
| return for receipt of a fee, knowing that the conduct is to be | ||
| provided or performed by a victim of an offense under Chapter 20A. | ||
| (b) An offense under this section is a state jail felony, | ||
| unless it is shown on the trial of the offense that the defendant | ||
| has been previously convicted of an offense under this section, in | ||
| which event the offense is a felony of the third degree. | ||
| SECTION 2. This Act takes effect September 1, 2017. | ||
