A BILL TO BE ENTITLED
AN ACT
relating to the election and authority of the board of directors of
the McCulloch County Hospital District.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 1059.052, Special District Local Laws
Code, is amended to read as follows:
Sec. 1059.052. NOTICE OF ELECTION. Notice [Not earlier
than 30 days or later than 10 days before the date] of an election of
directors[, notice of the election] shall be published in
accordance with Section 4.003, Election Code, [one time] in a
newspaper with general circulation in the district.
SECTION 2. Section 1059.107, Special District Local Laws
Code, is amended by adding Subsection (f) to read as follows:
(f) The board by resolution may order the lease of a
hospital or other facility owned by the district to any person. The
resolution must include a finding by the board that the lease of the
hospital or facility is in the best interest of the residents of the
district.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2013.
