relating to space utilization and online enrollment requirements | ||
for the issuance of revenue bonds by certain public institutions of | ||
higher education. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 55.13, Education Code, is amended by | ||
adding Subsections (d), (e), and (f) to read as follows: | ||
(d) Notwithstanding any other provision of this chapter or | ||
other law, the board of a general academic teaching institution | ||
other than a public state college, or the Texas Public Finance | ||
Authority on behalf of that institution, if applicable, may not | ||
under this chapter issue bonds payable from revenue funds of the | ||
institution unless the institution has satisfied the standards | ||
prescribed by the Texas Higher Education Coordinating Board for: | ||
(1) space utilization in educational and general | ||
buildings and facilities at the institution; and | ||
(2) the percentage of students enrolled in the | ||
institution who enroll in online courses offered by the | ||
institution. | ||
(e) The Texas Higher Education Coordinating Board may adopt | ||
rules for the administration of Subsection (d). | ||
(f) In this section, "educational and general buildings and | ||
facilities," "general academic teaching institution," and "public | ||
state college" have the meanings assigned by Section 61.003. | ||
SECTION 2. The change in law made by this Act does not | ||
affect the validity of any bonds the issuance of which was | ||
authorized before the effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2015. |
