BACKGROUND AND PURPOSE
Allowing additional entities to donate unused prescription drugs will help increase access to prescription drugs for those who may not be able to afford them, while also ensuring the safety and quality of donated drugs. H.B. 4331 seeks to expand the types of entities that can donate unused prescription drugs to a provider participating in the collection and redistribution of donated prescription drugs by including a prescription drug manufacturer or health care facility, including a pharmacy.

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS
H.B. 4331 amends the Health and Safety Code to clarify, for purposes of donations of prescription drugs, that a donor, in addition to being an individual who donates unused prescription drugs to a provider that elects to participate in the collection and redistribution of donated prescription drugs, includes a prescription drug manufacturer or health care facility, including a pharmacy.
