Summary
As introduced, clarifies that the right of election against the estate of a deceased spouse is not an asset of the estate of the surviving spouse; declares that the personal representative of a deceased surviving spouse is not liable to any person or entity with an interest in the estate of the surviving spouse for loss or damages resulting from the personal representative's discretion to exercise or not exercise the surviving spouse's right to elect against the deceased spouse's estate; makes various other clarifications regarding the death of a surviving spouse before the time for electing the elective share expires. - Amends TCA Title 30; Title 31; Title 32; Title 34; Title 35 and Title 67.
