| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," in school districts, further |
6 | providing for value-added assessment system. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. Section 221 of the act of March 10, 1949 (P.L.30, |
10 | No.14), known as the Public School Code of 1949, added November |
11 | 17, 2010 (P.L.996, No.104), is amended to read: |
12 | Section 221. Value-added Assessment System.--(a) Beginning |
13 | on the effective date of this section, the Department of |
14 | Education shall make available on its publicly accessible |
15 | Internet website the following: |
16 | (1) Value-added assessment system data for the school |
17 | district level [and], the school level, the grade level and the |
18 | classroom level. The Department of Education's disclosure of |
19 | value-added assessment system data shall be subject to the |
20 | Family Educational Rights and Privacy Act of 1974 (Public Law |

1 | 90-247, 20 U.S.C. § 1232g) or a successor Federal statute. |
2 | (2) Instructions that may assist the public in understanding |
3 | and interpreting the data provided under paragraph (1). |
4 | (b) For purposes of this section: |
5 | "Value-added assessment system" shall mean a statistical |
6 | analysis of results on the Pennsylvania System of School |
7 | Assessment test or any other test established by the State Board |
8 | of Education to meet the requirements of section 2603-B(d)(10) |
9 | (i) pursuant to 22 Pa. Code § 403.3 (relating to single |
10 | accountability system) that uses measures of student learning to |
11 | enable the estimation of classroom, grade, school or school |
12 | district statistical distributions. |
13 | Section 2. This act shall take effect in 60 days. |
