AN ACT

Requiring forfeiture of salaries for the Governor, Lieutenant

2

Governor, Cabinet members and members of the General Assembly

3

for failure to pass a timely budget.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Salary forfeiture.

7

(a)  Salaries to be withheld.--In the event that a balanced

8

operating budget, including a General Appropriation Act and a

9

General Revenue Act or acts, if necessary, has not be enacted by

10

12 midnight on the final day of any fiscal year, the Secretary

11

of the Budget, the Chief Clerk of the Senate and the Chief Clerk

12

of the House of Representatives shall withhold all salaries for

13

the Governor, Lieutenant Governor, Cabinet members and members

14

of the General Assembly.

(b)  Procedure.--In the event that a budget is not passed in

16

accordance with subsection (a), the Governor, Lieutenant

17

Governor, Cabinet members and members of the General Assembly

18

shall forfeit a proportional amount of pay for each day that the

budget is not passed. There shall be no retroactive repayment of

2

salary once the budget is passed. The Secretary of the Budget,

3

the Chief Clerk of the Senate and the Chief Clerk of the House

4

of Representatives shall determine the amount of pay to be

5

forfeited and shall transfer the forfeited salary to the General

6

Fund.

Section 2.  Effective date.

This act shall take effect immediately.
