AN ACT

  

1

Amending the act of March 20, 2002 (P.L.154, No.13), entitled

2

"An act reforming the law on medical professional liability;

3

providing for patient safety and reporting; establishing the

4

Patient Safety Authority and the Patient Safety Trust Fund;

5

abrogating regulations; providing for medical professional

6

liability informed consent, damages, expert qualifications,

7

limitations of actions and medical records; establishing the

8

Interbranch Commission on Venue; providing for medical

9

professional liability insurance; establishing the Medical

10

Care Availability and Reduction of Error Fund; providing for

11

medical professional liability claims; establishing the Joint

12

Underwriting Association; regulating medical professional

13

liability insurance; providing for medical licensure

14

regulation; providing for administration; imposing penalties;

15

and making repeals," further providing for abatement

16

programs, for procedure and for expiration.

The General Assembly of the Commonwealth of Pennsylvania

18

hereby enacts as follows:

19

Section 1.  Section 1102 of the act of March 20, 2002

20

(P.L.154, No.13), known as the Medical Care Availability and

21

Reduction of Error (Mcare) Act, amended October 27, 2006

22

(P.L.1198, No.128), is amended to read:

Section 1102.  Abatement program.

24

(a)  Establishment.--There is hereby established within the

Insurance Department a program to be known as the Health Care

2

Provider Retention Program. The Insurance Department, in

3

conjunction with the Department of Public Welfare, shall

4

administer the program. The program shall provide assistance in

5

the form of assessment abatements to health care providers for

6

calendar years 2003, 2004, 2005, 2006 [and], 2007, 2008, 2009

7

and 2010 except that licensed podiatrists shall not be eligible

8

for calendar years 2003 and 2004, and nursing homes shall not be

9

eligible for calendar years 2003, 2004 and 2005.

10

(b)  Other abatement.--Emergency physicians not employed full

11

time by a trauma center or working under an exclusive contract

12

with a trauma center shall retain eligibility for an abatement

13

pursuant to section 1104(b)(2) for calendar years 2003, 2004,

14

2005 and 2006. Commencing in calendar year 2007, these emergency

15

physicians shall be eligible for an abatement pursuant to

16

section 1104(b)(1).

Section 2.  Section 1104(a) of the act, added December 22,

18

2005 (P.L.458, No.88), is amended to read:

19

Section 1104.  Procedure.

20

(a)  Application.--A health care provider may apply to the

21

Insurance Department for an abatement of the assessment imposed

22

for the previous calendar year specified on the application.

23

[The] Except for abatement applications for calendar year 2008,

24

the application must be submitted by the second Monday of

25

February of the calendar year specified on the application and

26

shall be on the form required by the Insurance Department. The

27

department shall require that the application contain all of the

28

following supporting information:

(1)  A statement of the applicant's field of practice,

30

including any specialty.

(2)  Except for physicians enrolled in an approved

2

residency or fellowship program, a signed certificate of

3

retention.

4

(3)  A signed certification that the health care provider

5

is an eligible applicant under section 1103 for the program.

6

(4)  Such other information as the Insurance Department

7

may require.

Section 3.  Section 1115 of the act, amended October 27, 2006

10

(P.L.1198, No.128), is amended to read:

11

Section 1115.  Expiration.

12

The Health Care Provider Retention Program established under

13

this chapter shall expire December 31, [2008] 2010.

14

Section 4.  The amendment of section 1115 of the act shall be

15

retroactive to December 31, 2008.

16

Section 5.  This act shall take effect immediately.
