AN ACT
1Amending the act of March 28, 1984 (P.L.150, No.28), entitled,
2as amended, "An act relating to the rights of purchasers and
3lessees of defective new motor vehicles," further providing
4for presumption of a reasonable number of attempts.
5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:
7Section 1. Section 6(a) of the act of March 28, 1984
8(P.L.150, No.28), known as the Automobile Lemon Law, amended
9April 12, 2012 (P.L.245, No.33), is amended to read:
10Section 6. Presumption of a reasonable number of attempts.
11(a) General rule.--It shall be presumed that a reasonable
12number of attempts have been undertaken to repair or correct a
13nonconformity if:
14(1) the same nonconformity has been subject to repair
15three times by the manufacturer, its agents or authorized
16dealers and the nonconformity still exists[; or], other than
17a nonconformity subject to examination or repair pursuant to
18paragraph (3) because it is likely to cause death or serious
1bodily injury if the vehicle is driven and the nonconformity
2still exists;
3(2) the vehicle is out-of-service by reason of any
4nonconformity for a cumulative total of 30 or more calendar
5days[.]; or
6(3) the nonconformity is likely to cause death or
7serious bodily injury if the vehicle is driven, the
8nonconformity has been subject to examination or repair at
9least once by the manufacturer, its agents or authorized
10dealers and the nonconformity still exists.
