AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, further providing for the

3

commencement of actions.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 5551(5) of Title 42 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 5551.  No limitation applicable.

9

A prosecution for the following offenses may be commenced at

10

any time:

11

(5)  A violation of [75 Pa.C.S. § 3742 (relating to

13

accidents involving death or personal injury) or 3732

14

(relating to homicide by vehicle)] any of the following if

15

the accused was the driver of a vehicle involved in an

16

accident resulting in the death of any person[.]:

17

(i)  75 Pa.C.S. § 3732 (relating to homicide by

18

vehicle).

(ii)  75 Pa.C.S. § 3735 (relating to homicide by

2

vehicle while driving under influence).

3

(iii)  75 Pa.C.S. § 3742 (relating to accidents

4

involving death or personal injury).

5

(iv)  75 Pa.C.S. § 3742.1 (relating to accidents

6

involving death or personal injury while not properly

7

licensed).

Section 2.  This act shall take effect in 60 days.
