| AN ACT |
| |
1 | Amending Title 62 (Procurement) of the Pennsylvania Consolidated |
2 | Statutes, providing for small business reserve. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Title 62 of the Pennsylvania Consolidated |
6 | Statutes is amended by adding a section to read: |
7 | § 2109. Small business reserve. |
8 | (a) General rule.--All Commonwealth agencies, independent |
9 | agencies, State-affiliated agencies, quasi-independent agencies, |
10 | boards, commissions, colleges and universities shall establish a |
11 | small business reserve for the purpose of increasing economic |
12 | opportunities for small businesses and affording small |
13 | businesses, including disadvantaged businesses, the opportunity |
14 | to bid on State government contracts without competing with |
15 | larger businesses. |
16 | (b) Amount.--Pursuant to section 2101 (relating to policy), |
17 | all Commonwealth agencies, boards, commissions, colleges and |
18 | universities shall set 10% of their procurement dollars into |

1 | their small business reserves for award to qualified small |
2 | businesses. This amount shall consist of procurement dollars |
3 | beginning at $25,000 up to an amount not to exceed $5,000,000. |
4 | (c) Self-certification.--Bidders shall self-certify that |
5 | they are qualified small businesses, and verification of status |
6 | shall be confirmed by the awarding agency, board or commission |
7 | prior to award. |
8 | (d) Tier categories.--The small business reserve shall be |
9 | categorized in the following tiers: |
10 | (1) Tier 1: 0-100 employees with gross revenues not |
11 | exceeding $25,000,000. All small businesses in this tier may |
12 | bid on any small business reserve contract. |
13 | (2) Tier 2: 101-200 employees with gross revenues not |
14 | exceeding $35,000,000. Small businesses in this tier may only |
15 | compete for contracts $100,000 and greater. |
16 | (3) Tier 3: 201-250 employees with gross revenues not |
17 | exceeding $45,000,000. Small businesses in this tier may only |
18 | compete for contracts $250,000 and greater. |
19 | Section 2. This act shall take effect in 60 days. |
