AN ACT

Amending the act of December 30, 2003 (P.L.441, No.64), entitled

2

"An act requiring certifications by tobacco product

3

manufacturers; providing for a directory of cigarettes

4

approved for stamping and sale; conferring powers and

5

imposing duties on the Attorney General and the Department of

6

Revenue; and imposing penalties," further providing for

7

directory.

The General Assembly of the Commonwealth of Pennsylvania

9

hereby enacts as follows:

Section 1.  Section 301(3) of the act of December 30, 2003

11

(P.L.441, No.64), known as the Tobacco Product Manufacturer

12

Directory Act, is amended to read:

13

Section 301.  Directory.

14

The Attorney General shall develop and publish a directory of

15

all tobacco product manufacturers and their brand families that

16

have provided current and accurate certification under section

17

303. The directory shall be available on the Office of Attorney

18

General's World Wide Web site. The following shall apply:

(3)  The Attorney General shall provide notice to the

21

registered agent of the affected tobacco product manufacturer

when the Attorney General determines to add a manufacturer or

2

its brand families or to remove the manufacturer or its brand

3

families from the directory. Upon notification of a

4

distributor by a tobacco product manufacturer of a

5

determination of the Attorney General to remove the tobacco

6

product manufacturer or its brand families from the

7

directory, the distributor shall notify its retailers. A

8

determination of the Attorney General to remove a tobacco

9

product manufacturer or brand families from the directory

10

shall take effect 21 days after notice of that determination

11

appears in the directory except that for purposes of retail

12

sales, the determination shall take effect 45 days after

13

notice of the determination appears in the directory.

Section 2.  This act shall take effect in 60 days.
