AN ACT

Amending Title 20 (Decedents, Estates and Fiduciaries) of the

2

Pennsylvania Consolidated Statutes, providing for provision

3

of decedent's life insurance information to a licensed

4

funeral director; and imposing a duty on the Insurance

5

Department.

6

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Title 20 of the Pennsylvania Consolidated

9

Statutes is amended by adding a section to read:

10

§ 3101.1.  Provision of decedent's life insurance information.

11

(a)  Right to request.--A licensed funeral director or an

12

employee of a licensed funeral director may request information

13

from an insurer regarding a decedent's contract for life

14

insurance by providing the insurer written authorization from

15

the person with legal authority to dispose of the body of the

16

decedent under section 305 (relating to right to dispose of a

17

decedent's remains).

18

(b)  Duty of insurer.--As soon as possible after receipt of

19

the request, the insurer shall inform the person authorized to

20

make an inquiry under subsection (a) of the following:

(1)  The existence of a contract insuring the life of the

2

decedent.

3

(2)  Beneficiaries on record under a life insurance

4

contract insuring the life of the decedent.

5

(3)  The amount of liens or loans outstanding on the

6

policy.

7

(4)  The amount of benefits payable to the beneficiaries. 

8

(5)  Whether the policy has been reinstated within the 24

9

months immediately preceding the inquiry.

The insurer shall provide a claim form to a person or assignee

11

making the request.

12

(c)  Response from insurer.--If a person making a written

13

request under subsection (a) has provided the information

14

required and does not receive a timely response from the

15

insurer, he may refer the request to the Insurance Department

16

which shall treat the referral as a consumer complaint. The

17

referral shall include all the information provided to the

18

insurer under subsection (a) as well as copies of the

19

communications and information received from the insurer

20

regarding the request for information.

21

(d)  Beneficiary of life insurance contract.--If the

22

beneficiary of record under a contract for life insurance for

23

which information was requested under subsection (a) is not the

24

decedent's personal representative, heir or devisee, then a

25

person authorized to request information under subsection (a)

26

shall make reasonable efforts to locate the beneficiary within

27

100 hours of receiving information from the insurer regarding a

28

life insurance contract and shall provide to the beneficiaries

29

the documents and information obtained from the insurer.

(e)  Duty to inform.--The person obtaining the information

under subsection (a) shall inform the beneficiaries in writing

2

and bold print that:

THE BENEFICIARY OF A LIFE INSURANCE CONTRACT HAS NO LEGAL

4

DUTY OR OBLIGATION TO SPEND THE PROCEEDS ON THE FUNERAL,

5

DEBTS OR OBLIGATIONS OF THE DECEASED.

6

This duty shall be performed before discussing with the

7

beneficiaries financial arrangements for burial of the deceased. 

8

(f)  False request for information.--A licensed funeral

9

director or an employee of a licensed funeral director who makes

10

a false request for information under this section or fails to

11

inform under subsection (e) shall be in violation of 18 Pa.C.S.

12

§ 4107 (relating to deceptive or fraudulent business practices)

13

and shall be subject to license revocation under section 11 of

14

the act of January 14, 1952 (1951 P.L.1898, No.522), known as

15

the Funeral Director Law.

16

(g)  Report.--The Insurance Department shall report to the

17

chair and minority chair of the Banking and Insurance Committee

18

of the Senate and the chair and minority chair of the Insurance

19

Committee of the House of Representatives by March 1, 2011, the

20

following:

21

(1)  The number of referrals under subsection (c).

22

(2)  The identity of the insurers whose refusal or delay

23

resulted in the referrals.

24

(3)  The reasons the insurers were unable to respond to

25

the inquiries.

26

(4)  Recommendations for administrative, legislative or

27

regulatory changes needed to enhance the ability of persons

28

arranging for funeral services to obtain timely access to

29

information about a life insurance contract which was

30

assented to by a decedent.
