AN ACT
Amending the act of May 1, 1933 (P.L.103, No.69), entitled, as
reenacted and amended, "An act concerning townships of the
second class; and amending, revising, consolidating and
changing the law relating thereto," further providing for
township manager, appointment, removal, powers and duties,
compensation and bond; and providing for evasion of
requirements.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1301 of the act of May 1, 1933 (P.L.103,
No.69), known as The Second Class Township Code, reenacted and
amended November 9, 1995 (P.L.350, No.60), is amended by adding
a subsection to read:
Section 1301. Township Manager; Appointment, Removal, Powers
and Duties; Compensation; Bond.--* * *
(d) No individual shall be appointed to the office of
township manager in the township in which he was elected to
serve as township supervisor until ninety days after the date he
left the office, whether by expiration of a term, resignation or
for any other reason.
Section 2. The act is amended by adding a section to read:
Section 1302. Evasion of Requirements.--No supervisor shall
vote to evade the requirements of this article by appointing or
employing a person in a capacity substantially similar to that
of the township manager except as provided in section 1301.
Section 3. This act shall take effect immediately.
