| AN ACT |
| |
1 | Amending the act of May 1, 1933 (P.L.103, No.69), entitled, as |
2 | reenacted and amended, "An act concerning townships of the |
3 | second class; and amending, revising, consolidating and |
4 | changing the law relating thereto," further providing for |
5 | township manager, appointment, removal, powers and duties, |
6 | compensation and bond; and providing for evasion of |
7 | requirements. |
8 | The General Assembly of the Commonwealth of Pennsylvania |
9 | hereby enacts as follows: |
10 | Section 1. Section 1301 of the act of May 1, 1933 (P.L.103, |
11 | No.69), known as The Second Class Township Code, reenacted and |
12 | amended November 9, 1995 (P.L.350, No.60), is amended by adding |
13 | a subsection to read: |
14 | Section 1301. Township Manager; Appointment, Removal, Powers |
15 | and Duties; Compensation; Bond.--* * * |
16 | (d) No individual shall be appointed to the office of |
17 | township manager in the township in which he was elected to |
18 | serve as township supervisor until ninety days after the date he |
19 | left the office, whether by expiration of a term, resignation or |
20 | for any other reason. |

1 | Section 2. The act is amended by adding a section to read: |
2 | Section 1302. Evasion of Requirements.--No supervisor shall |
3 | vote to evade the requirements of this article by appointing or |
4 | employing a person in a capacity substantially similar to that |
5 | of the township manager except as provided in section 1301. |
6 | Section 3. This act shall take effect immediately. |
