AN ACT

Providing for the distribution of funds under the American

2

Recovery and Reinvestment Act of 2009.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

5

Section 1.  Short title.

6

This act shall be known and may be cited as the American

7

Recovery and Reinvestment Act of 2009 Fund Distribution Act.

8

Section 2.  Definitions.

9

The following words and phrases when used in this act shall

10

have the meanings given to them in this section unless the

11

context clearly indicates otherwise:

12

"American Recovery and Reinvestment Act of 2009."  The

13

American Recovery and Reinvestment Act of 2009 (Public Law

14

111-5, 123 Stat. 115).

15

Section 3.  Distribution of funds.

16

(a)  Review and evaluation.--Each State agency shall review

and evaluate whether the State agency is eligible for or would

2

request funding under any provision of the American Recovery and

3

Reinvestment Act of 2009. If any State agency determines it is

4

eligible and desires to receive funding under any provision of

5

the American Recovery and Reinvestment Act of 2009, the State

6

agency shall notify the Majority Leader and Minority Leader of

7

the Senate, the Majority Leader and Minority Leader of the House

8

of Representatives, the chairman and minority chairman of the

9

Appropriations Committee of the Senate and the chairman and

10

minority chairman of the Appropriations Committee of the House

11

of Representatives, within ten days after the effective date of

12

this section, of the determination and shall provide the

13

following information in conjunction with the notification:

14

(1)  The amount of funds the State agency desires to

15

receive under the American Recovery and Reinvestment Act of

16

2009.

17

(2)  Each of the titles and sections of the American

18

Recovery and Reinvestment Act of 2009 under which the desired

19

funds are provided.

20

(3)  The requirements and deadline for applying for the

21

desired funding under the American Recovery and Reinvestment

22

Act of 2009.

23

(4)  The requirements associated with the desired

24

funding, including spending limitations, State-matching or

25

cost-sharing requirements, percentage limitations and any

26

time requirements regarding expenditure of the funding.

27

(5)  When the funding provided under the American

28

Recovery and Reinvestment Act of 2009 will end.

29

(6)  If any additional State employees are necessary to

30

oversee or administer the funds received under the American

Recovery and Reinvestment Act of 2009 and, if so, how many

2

full-time equivalent positions would be required.

(7)  The number of potential jobs created by the use of

4

any funds received under the American Recovery and

5

Reinvestment Act of 2009, including all rationales and

6

supporting data justifying the State agency's estimate of the

7

number of jobs to be created. 

8

(8)  A plan detailing how the funds received under the

9

American Recovery and Reinvestment Act of 2009 will be

10

expended and how the State agency will address the absence of

11

funding after the funding provided under the American

12

Recovery and Reinvestment Act of 2009 ends.

13

(b)  Notification.--Each State agency that applies for and

14

receives or is approved to receive funds under the American

15

Recovery and Reinvestment Act of 2009 shall notify the Majority

16

Leader and Minority Leader of the Senate, the Majority Leader

17

and Minority Leader of the House of Representatives, the

18

chairman and minority chairman of the Appropriations Committee

19

of the Senate and the chairman and minority chairman of the

20

Appropriations Committee of the House of Representatives

21

immediately of the receipt or approval. Each State agency

22

expending funds received under the American Recovery and

23

Reinvestment Act of 2009 shall make the expenditures in

24

accordance with the provisions of appropriation acts in

25

compliance with the provisions of applicable State statutes.

26

(c)  Prohibition.--Under the act of June 29, 1976 (P.L.469,

27

No.117), entitled "An act relating to the fiscal affairs of the

28

Commonwealth concerning duties of the Governor, the Secretary of

29

Revenue and the Budget Secretary, with respect to the submission

30

of and signing the budget for any fiscal year; and, after a

budget is enacted, regulating the issuance of warrants by the

2

State Treasurer for certain requisitioned funds and imposing

3

duties on persons authorized by law to issue requisitions for

4

the payment of moneys from the State Treasury; and prescribing

5

that Federal funds received by the Commonwealth shall be

6

deposited in the General Fund account with certain exceptions,"

7

on and after the effective date of this section, neither the

8

Governor nor any other State agency may expend any funding under

9

the American Recovery and Reinvestment Act of 2009 unless

10

appropriated by the General Assembly.

(d)  Employment.--Any individual employed by a State agency

12

in connection with or as a result of funding received under the

13

American Recovery and Reinvestment Act of 2009 shall be a

14

temporary employee, and the employment may not continue beyond

15

the expenditure of the funds received under the American

16

Recovery and Reinvestment Act of 2009.

17

(e)  Limit.--No expenditures may be made by any State agency

18

of any funds received under the American Recovery and

19

Reinvestment Act of 2009, and no State agency may enter into any

20

contract or other obligation to expend any amount in excess of

21

the actual amount of funds appropriated to the State agency

22

under State law.

Section 10.  Effective date.

24

This act shall take effect immediately.
