AN ACT
Amending Title 61 (Prisons and Parole) of the Pennsylvania
Consolidated Statutes, in medical services, providing for
medical assistance.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 61 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
§ 3308. Medical assistance.
For each inmate who, at the time of incarceration, is
eligible for the program under subdivision (f) of Article IV of
the act of June 13, 1967 (P.L.31, No.21), known as the Public
Welfare Code, a chief administrative officer shall cooperate
with the Department of Public Welfare to do one of the
following:
(1) Maintain the inmate's eligibility during
incarceration.
(2) Suspend, rather than terminate, the inmate's
eligibility during incarceration and restore eligibility upon
release.
Section 2. This act shall take effect in 60 days.
