| AN ACT |
| |
1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, further providing for |
3 | collection of court costs, restitution and fines by private |
4 | collection agency. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 9730.1(c) of Title 42 of the Pennsylvania |
8 | Consolidated Statutes is amended to read: |
9 | § 9730.1. Collection of court costs, restitution and fines by |
10 | private collection agency. |

12 | (c) Limitations on private collection agencies.--For the |
13 | purposes of this section, a private collection agency shall |
14 | cease its efforts designed to collect fines, costs and |
15 | restitution and so inform the court or the county commissioners |
16 | upon the occurrence of any of the following: |
17 | (1) the private collection agency considers the amount |
18 | owing noncollectible; |

1 | (2) a period of [180 days] 48 months has elapsed since |
2 | referral of the amount owing to the private collection agency |
3 | and there has been no response by the defendant or collection |
4 | of moneys; or |
5 | (3) upon demand of a judge of the court of common pleas |
6 | having jurisdiction over the defendant. |

8 | Section 2. This act shall take effect in 60 days. |
