| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, in other offenses, further providing |
3 | for violation of rules regarding conduct on Commonwealth |
4 | property. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 7506 of Title 18 of the Pennsylvania |
8 | Consolidated Statutes is amended to read: |
9 | § 7506. Violation of rules regarding conduct on Commonwealth |
10 | property. |
11 | (a) Promulgation of rules and regulations.--The Department |
12 | of [Environmental] Conservation and Natural Resources, |
13 | Pennsylvania Game Commission and Pennsylvania Historical and |
14 | Museum Commission may promulgate rules and regulations governing |
15 | conduct, other than conduct regulated in section 7505 (relating |
16 | to violation of governmental rules regarding traffic), on |
17 | Commonwealth property within the jurisdiction of that agency. |

1 | Such rules and regulations shall be reasonably related to the |
2 | preservation and protection of such property for its specified |
3 | or intended use, or to promote the welfare, safety or protection |
4 | of those persons using such property, shall be consistent with |
5 | existing law and shall be posted in a manner reasonable likely |
6 | to come to the attention of persons using such property. |
7 | (a.1) Exception for shooting ranges.--Notwithstanding the |
8 | provisions of subsection (a) or the act of June 28, 1995 |
9 | (P.L.89, No.18), known as the Conservation and Natural Resources |
10 | Act, and regulations promulgated under that act, the Department |
11 | of Conservation and Natural Resources may not suspend or revoke |
12 | normal shooting activities on a shooting range operated by an |
13 | entity other than the Department of Conservation and Natural |
14 | Resources on property owned or controlled by the Department of |
15 | Conservation and Natural Resources. |
16 | (b) Violation penalty.--A person who violates any of the |
17 | rules and regulations promulgated pursuant to this section is |
18 | guilty of a summary offense. |
19 | (c) Definition.--As used in this section, the term "shooting |
20 | range" means a hunting club, rifle club, rifle range, shotgun |
21 | range, pistol range or other firing range on property owned or |
22 | controlled by the Department of Conservation and Natural |
23 | Resources and that was in operation as of January 1, 2003, by |
24 | any of the following: |
25 | (1) A nonprofit corporation or similar entity. |
26 | (2) The Commonwealth or an agency of the Commonwealth. |
27 | (3) A political subdivision or an agency of a political |
28 | subdivision. |
29 | Section 2. This act shall take effect in 60 days. |
