AN ACT

 

1Amending the act of December 19, 1988 (P.L.1262, No.156),
2entitled, as amended, "An act providing for the licensing of
3eligible organizations to conduct games of chance, for the
4licensing of persons to distribute games of chance, for the
5registration of manufacturers of games of chance, and for
6suspensions and revocations of licenses and permits;
7requiring records; providing for local referendum by
8electorate; and prescribing penalties," further providing for
9definitions, for regulations and for club licensee.

10The General Assembly of the Commonwealth of Pennsylvania
11hereby enacts as follows:

12Section 1. The definition of "games of chance" in section
13103 of the act of December 19, 1988 (P.L.1262, No.156), known as
14the Local Option Small Games of Chance Act, amended October 24,
152012 (P.L.1462, No.184), is amended and the section is amended
16by adding definitions to read:

17Section 103. Definitions.

18The following words and phrases when used in this act shall
19have the meanings given to them in this section unless the
20context clearly indicates otherwise:

2"Games of chance." Punchboards, daily drawings, weekly 
3drawings, 50/50 drawings, raffles, selective raffles and pull-
4tabs, as defined in this act, provided that no such game shall 
5be played by or with the assistance of any mechanical or 
6electrical devices or media other than a dispensing machine or 
7passive selection device and further provided that the 
8particular chance taken by any person in any such game shall not 
9be made contingent upon any other occurrence or the winning of 
10any other contest, but shall be determined solely at the 
11discretion of the purchaser. This definition shall not be 
12construed to authorize any other form of gambling currently 
13prohibited under any provision of Title 18 of the Pennsylvania 
14Consolidated Statutes (relating to crimes and offenses) or 
15authorized under 4 Pa.C.S. (relating to amusements). Nothing in 
16this act shall be construed to authorize games commonly known as 
17"slot machines" or "video poker."

19"Selective raffle." A game in which:

20(1) A participant buys a ticket for a chance to win a
21donated prize.

22(2) The participant places his or her ticket in a
23designated location for the prize which he or she would like
24to win.

25(3) The winner for each prize is determined by a random
26drawing of tickets with a corresponding number for the prize.

28Section 2. Section 306(c) of the act, amended October 24,
292012 (P.L.1462, No.184), is amended and the section is amended
30by adding a subsection to read:

2(c) Reporting requirements.--[Each] Except as provided under 
3subsection (c.1), each eligible organization which has proceeds
4in excess of $2,500 in a calendar year shall submit an annual
5report to the department including:

6(1) Prizes awarded as required under section 335 of the
7act of March 4, 1971 (P.L.6, No.2), known as the Tax Reform
8Code of 1971.

9(2) Amounts expended for public interest purposes.

10(c.1) Exception.--The following shall not be included in the
11report required under subsection (c):

12(1) Prizes awarded from a 50/50 drawing which do not
13exceed $1,000 per game; and

14(2) Prizes awarded from a selective raffle which do not
15exceed $5,000 per game.

16Section 3. Section 501(a) of the act is amended by adding a
17paragraph to read:

21(4) The following shall not be included in the report
22required under paragraph (1).

23(i) Prizes awarded from a 50/50 drawing which do not
24exceed $1,000 per game.

25(ii) Prizes awarded from a selective raffle which do
26not exceed $5,000 per game.

28Section 4. This act shall take effect in 60 days.
