| AN ACT |
| |
1 | Amending Title 65 (Public Officers) of the Pennsylvania |
2 | Consolidated Statutes, further providing for restricted |
3 | activities and for prohibited activities. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Sections 1103 and 13A07 of Title 65 of the |
7 | Pennsylvania Consolidated Statutes are amended by adding |
8 | subsections to read: |
9 | § 1103. Restricted activities. |

11 | (k) Limitations on persons hired or appointed as public |
12 | employees or officials.-- |
13 | (1) No individual who is hired as a public employee of |
14 | the Commonwealth may, within a period of two years after the |
15 | date of hiring or a period beginning with the date of hiring |
16 | and ending with the last day of the sitting Governor's term |

1 | of office, whichever is shorter, participate in a matter that |
2 | is directly and substantially related to any former employee |
3 | or former client, including any matter involving regulations |
4 | or contracts. |
5 | (2) No individual who is appointed as a public official |
6 | of the Commonwealth may, within a period of two years after |
7 | the date of appointment or a period beginning with the date |
8 | of appointment and ending with the last day of the sitting |
9 | Governor's term of office, whichever is shorter, participate |
10 | in a matter that is directly and substantially related to any |
11 | former employee or former client, including any matter |
12 | involving regulations or contracts. |
13 | (3) No individual who is subject to paragraph (1) or (2) |
14 | and who was a registered lobbyist under Chapter 13A (relating |
15 | to lobbying disclosure) within two years prior to hiring or |
16 | appointment may, within a period of two years after the date |
17 | of hiring or appointment or a period beginning with the date |
18 | of hiring or appointment and ending with the last day of the |
19 | sitting Governor's term of office, whichever is shorter, |
20 | participate in any matter on which the individual lobbied |
21 | within two years prior to hiring or appointment. |
22 | (4) No individual who is or was a registered lobbyist |
23 | under Chapter 13A may accept employment with an agency of the |
24 | Commonwealth that the person lobbied within a period of two |
25 | years prior to the date of hiring or appointment. |
26 | (5) No individual who is hired or appointed as a public |
27 | employee or public official of the Commonwealth may serve on |
28 | an evaluation committee formed under 62 Pa.C.S. § 513 |
29 | (relating to competitive sealed proposals) to review |
30 | proposals submitted in response to requests for proposals if |

1 | the evaluation committee will consider a proposal submitted |
2 | by a person who was a former employer or a former client of |
3 | the person within two years prior to the individual's hiring |
4 | or appointment. |
5 | § 13A07. Prohibited activities. |

7 | (g) Lobbying by former public officials and public employees |
8 | of the Commonwealth.--No former public official or public |
9 | employee of the Commonwealth shall lobby the agency with whom he |
10 | or she was associated for a period of two years after he or she |
11 | leaves the agency. |
12 | Section 2. This act shall take effect in 60 days. |
