AN ACT

Amending the act of August 6, 1941 (P.L.861, No.323), entitled,

2

as amended, "An act to create a uniform and exclusive system

3

for the administration of parole in this Commonwealth;

4

providing state probation services; establishing the

5

'Pennsylvania Board of Probation and Parole'; conferring and

6

defining its jurisdiction, duties, powers and functions;

7

including the supervision of persons placed upon probation

8

and parole in certain designated cases; providing for the

9

method of appointment of its members; regulating the

10

appointment, removal and discharge of its officers, clerks

11

and employes; dividing the Commonwealth into administrative

12

districts for purposes of probation and parole; fixing the

13

salaries of members of the board and of certain other

14

officers and employes thereof; making violations of certain

15

provisions of this act misdemeanors; providing penalties

16

therefor; and for other cognate purposes, and making an

17

appropriation," further providing for supervision by county

probation and parole officers.

The General Assembly of the Commonwealth of Pennsylvania

20

hereby enacts as follows:

21

Section 1.  Section 27.2(d) of the act of August 6, 1941

(P.L.861, No.323), referred to as the Pennsylvania Board of

23

Probation and Parole Law, is amended by adding paragraphs to

(7)  It is not the intent of the General Assembly to

5

authorize officers or law enforcement officers to conduct

6

personal or property searches for the sole purpose of

7

harassment.

(8)  An inmate who is eligible for release on parole from an

9

offense under 18 Pa.C.S. Pt. II Art. B (relating to offenses

10

involving danger to the person) or Ch. 61 (relating to firearms

11

and other dangerous articles) must agree in writing to be

12

subject to search or seizure by an officer or law enforcement

13

officer at any time, with or without a search warrant and with

14

or without cause.

(9)  An officer or law enforcement officer may conduct a

16

personal or property search of an inmate released on parole from

17

an offense under 18 Pa.C.S. Pt. II Art. B or Ch. 61 without a

18

warrant and without cause.

Section 2.  This act shall take effect in 60 days.

Section 1.  Section 21 of the act of August 6, 1941 (P.L.861,

No.323), referred to as the Pennsylvania Board of Probation and

23

Parole Law, is amended by adding a subsection to read:

24

(f)  A person convicted of an offense constituting a felony

26

under 18 Pa.C.S. Pt. II Art. B (relating to offenses involving

27

danger to the person) or Ch. 61 (relating to firearms and other

28

dangerous articles) shall not be placed on probation or released

29

on parole unless the person agrees in writing to be subject to

30

search or seizure by a State parole agent, county probation and

parole officer or police officer at any time, with or without a

2

search warrant and with or without cause. The agreement to be

3

subject to search shall include a search of the person and a

4

search of real or other property in the possession or under the

5

control of the person.

Section 2.  The act is amended by adding a section to read:

7

Section 27.3.  (a)  Notwithstanding the provisions of

8

sections 27.1 and 27.2, a State parole agent, county probation

9

and parole officer or police officer may conduct a search of a

10

person, and a search of real or other property in the possession

11

or under the control of a person, who has been released on

12

probation or parole for an offense constituting a felony under

13

18 Pa.C.S. Pt. II Art. B (relating to offenses involving danger

14

to the person) or Ch. 61 (relating to firearms and other

15

dangerous articles) at any time, with or without a search

16

warrant and with or without cause.

(b)  The provisions of this section shall apply only if the

18

State parole agent, county probation and parole officer or

19

police officer were aware at the time of the search or seizure

20

that the person had been released on probation or parole for an

21

offense constituting a felony under 18 Pa.C.S. Pt. II Art. B or

22

Ch. 61 and was subject to the provisions of this section.

23

(c)  A person subject to the provisions of this section shall

24

remain subject to all other provisions of this act.

25

(d)  It is not the intent of the General Assembly to

26

authorize State parole agents, county probation and parole

27

officers or police officers to conduct personal or property

28

searches for the sole purpose of harassment.

29

Section 3.  The provisions of section 21(f) and 27.3 of the

30

act shall apply to any person placed on probation or parole

after the effective date of this section.

Section 4.  This act shall take effect in 60 days.
