AN ACT

Amending Title 34 (Game) of the Pennsylvania Consolidated

Statutes, in hunting and furtaking, further providing for

3

unlawful acts concerning licenses; and, in special licenses

and permits, further providing for authority to issue

permits, for permit fees and for falconry permits.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

Section 1.  Section 2711 of Title 34 of the Pennsylvania

9

Consolidated Statutes is amended by adding a subsection to read:

10

§ 2711.  Unlawful acts concerning licenses.

11

(a.1)  Exception.--For the sole purpose of implementing and

13

enhancing a mentor mentored youth hunting program within this

Commonwealth, the commission may establish regulations exempting

15

certain limited youth hunting activities from the prohibitions

16

specified in subsection (a)(1), (3), (5) and (8). Such exemption

shall include a provision limiting a mentored youth

2

participating in a mentored youth hunting program to the receipt

3

of no more than one antlerless deer license in each license

4

year.

Section 2.  Sections 2901(e), 2904(a)(7) and 2925(a) and (b)

of Title 34 are amended to read:

§ 2901.  Authority to issue permits.

(e)  Falconry permits.--Notwithstanding the provisions of

11

subsection (a), falconry permits may be issued only to persons

12

who are residents of this Commonwealth and [16] 12 years of age

13

or older.

§ 2904.  Permit fees.

15

(a)  Annual fees.--The annual fee for permits provided for in

16

this chapter shall be as follows:

(7)  Falconry - [$25 for each raptor held] $50.

§ 2925.  Falconry permits.

(a)  Powers of commission.--The commission may adopt

22

regulations [consistent with Federal fish and wildlife laws and

23

regulations concerning the sport of falconry] to define,

24

implement and provide for the issuance of falconry permits to

25

eligible persons within this Commonwealth.

26

(b)  Unlawful acts.--It is unlawful [to practice any of the

27

actions defined as falconry under this section without a

28

falconry permit or to violate any regulation of the commission

29

or the United States Fish and Wildlife Service, whose

30

regulations pertaining to falconry are hereby made a part of

this title] for any person to engage in any falconry activities

2

without a valid falconry permit or to violate any regulation of

3

the commission relating to falconry.

Section 2 3.  This act shall take effect immediately.
