AN ACT

  

1

Imposing penalties on certain fraudulent practices relating to

2

motor vehicle airbag installation and reinstallation;

3

providing for duties of persons buying, selling and

4

installing airbags, for recordkeeping requirements and for

5

duty to disclose nonoperational airbags.

6

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Short title.

9

This act shall be known and may be cited as the Motor Vehicle

10

Airbag Fraud Prevention Act.

11

Section 2.  Definitions.

12

The following words and phrases when used in this act shall

13

have the meanings given to them in this section unless the

14

context clearly indicates otherwise:

15

"Airbag."  A component of an inflatable occupant restraint

16

system of a motor vehicle that is designed in accordance with

17

Federal safety regulations for the make, model and year of the

18

motor vehicle to be installed and to operate in the motor

19

vehicle to activate, as specified by the motor vehicle

manufacturer, in the event of a crash. The term includes, but is

2

not limited to, sensors, controllers, wiring and inflatable bag

3

of the system.

4

"Department."  The Department of Transportation of the

5

Commonwealth.

6

"Light manipulating system."  Anything that would mask or

7

cause the inaccurate indication of an airbag system status,

8

condition or operability.

9

"Salvaged airbag."  An OEM nondeployed airbag that has been

10

removed from a motor vehicle for use in another motor vehicle.

11

"VIN."  Vehicle identification number.

12

Section 3.  Installation or reinstallation of any false airbag.

13

(a)  Deceptive trade practice.--It is a deceptive trade

14

practice for a person to:

15

(1)  install or reinstall, as part of a motor vehicle

16

inflatable occupant restraint system, an object in lieu of an

17

airbag, including a light manipulating system;

18

(2)  sell or offer for sale any device with the intent

19

that the device will replace an airbag in any motor vehicle

20

if the person knows or reasonably should know that the device

21

does not meet Federal safety requirements;

22

(3)  sell or offer for sale any device that when

23

installed in a motor vehicle gives the impression that an

24

operable airbag is installed in that motor vehicle, including

25

any light manipulating system; or

26

(4)  intentionally misrepresent the presence of an airbag

27

when one does not exist.

28

Section 4.  Airbag antitheft.

(a)  Purchase, sale or installation of new or salvaged

30

airbag.--

(1)  A person engaged in the business of purchasing,

2

selling or installing salvaged airbags shall maintain a

3

manual or electronic record of the purchase, sale or

4

installation, which must include the identification number of

5

the airbag; the VIN of the vehicle from which the salvaged

6

airbag was removed; the name, address and driver's license

7

number or other means of identification of the person from

8

whom the salvaged airbag was purchased; and in the event that

9

the salvaged airbag is installed, the VIN of the motor

10

vehicle into which the airbag is installed. No new or

11

salvaged airbag shall be sold or installed which is or has

12

been subject to a specific manufacturer's or appropriate

13

authority's notice of recall.

14

(2)  (i)  A person engaged in the business of installing

15

a new replacement airbag shall maintain the name and tax

16

identification number of the supplier of the airbag and

17

record the VIN of the motor vehicle into which the airbag

18

is installed, as well as the identification number of the

19

airbag being installed. The identification number of the

20

previously deployed airbag being replaced shall be

21

recorded.

22

(ii)  Upon request of any law enforcement officer of

23

this Commonwealth or other authorized representative of

24

the agency charged with administration of this section,

25

the installer shall produce such records and permit said

26

agent or police officer to examine them.

27

(3)  A person who installs a salvaged airbag in a motor

28

vehicle shall apply a permanent, durable label that clearly

29

states that the motor vehicle contains a salvaged airbag. The

30

label shall be permanently installed on the dashboard of the

motor vehicle.

(4)  A person who sells a salvaged airbag or who installs

3

a salvaged airbag shall disclose to the purchaser and motor

4

vehicle owner that the airbag is salvaged.

5

(5)  A person who installs a new or salvaged airbag shall

6

submit an affidavit to the motor vehicle owner or the owner's

7

representative stating that the replacement airbag has been

8

properly installed.

9

(6)  All records shall be maintained for not less than

10

five years following the transaction and may be inspected

11

during normal business hours by any law enforcement officer

12

of this Commonwealth or other authorized representative of

13

the department.

14

(7)  Upon request, information within a portion of a

15

record pertaining to a specific transaction shall be provided

16

to the insurer and the motor vehicle owner.

17

(8)  A person engaged in the business of selling salvaged

18

airbags shall comply with regulations developed by the

19

department. The regulations shall include, but not be limited

20

to, the following standards:

21

(i)  Identification of the supplier of the unit.

22

(ii)  Identification of the recipient motor vehicle,

23

including VIN, year, make and model.

24

(iii)  Identification of the airbag module cover

25

color and color code, if available.

26

(iv)  Identification of the donor motor vehicle,

27

including VIN, year, make and model.

28

(v)  Supplier's internal stock number or locator

29

number.

30

(vi)  Indication of source of interchange information

(i.e., interchange manual/part number, OEM information,

2

etc.).

(vii)  A supplier certificate indicating that all the

4

requirements of the inspection protocol have been

5

successfully achieved and identifying the person who

6

completed the inspection.

7

(viii)  A document containing the motor vehicle

8

description including the year, make and model for which

9

the airbag system component is required when being sold

10

to the end user.

11

(9)  Salvage airbags conforming to the regulations

12

promulgated in accordance with paragraph (8) shall be

13

accompanied by a certificate of conformance which shall be

14

retained by the installer.

15

(b)  Prohibition.--

16

It is unlawful for any person to knowingly possess, sell

17

or install:

18

(i)  a stolen airbag;

19

(ii)  an airbag from which the manufacturer's part

20

number labeling or VIN has been removed, altered or

21

defaced; or

22

(iii)  an airbag taken from a stolen motor vehicle.

23

Section 5.  Accident reports.

24

A motor vehicle accident report that is filed by an

25

appropriate law enforcement agency shall clearly contain a

26

notation as to whether the motor vehicle's airbag or inflatable

27

restraint system was deployed in the accident.

28

Section 6.  Sale or trade of motor vehicle with an inoperable

29

airbag.

30

A person selling or trading a motor vehicle who has actual

knowledge that the motor vehicle's airbag is inoperable shall

2

notify the buyer or the person acquiring the trade in writing

3

that the airbag is inoperable.

4

Section 7.  Penalties.

5

Except as otherwise provided by this act:

6

(1)  Any person who violates section 3, 4(a)(3) or (b) or

7

6 is guilty of a felony and, upon conviction thereof, shall

8

be punished by a fine of not less than $1,000 and not more

9

than $2,000 per violation, or imprisonment for up to 2 years,

10

or both.

11

(2)  A person whose violation of section 3, 4(a)(3) or

12

(b) or 6 results in a serious bodily injury or death shall be

13

imprisoned for not more than 10 years or fined not more than

14

$100,000, or both.

15

(3)  Any person who fails to maintain complete and

16

accurate records, to prepare complete and accurate documents,

17

to provide information from such records upon request or to

18

properly disclose that an airbag is salvaged, as required by

19

this act, commits a misdemeanor of the third degree.

20

Section 8.  Effective date.

21

This act shall take effect in 60 days.
