AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, providing for reporting of suspected

3

abuse or a prohibited sexual act.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 6312 of Title 18 of the Pennsylvania

7

Consolidated Statutes is amended by adding a subsection to read:

8

§ 6312.  Sexual abuse of children.

(b.1)  Reporting of suspected abuse or prohibited sexual

11

act.--

12

(1)  Any commercial film or photographic print processor

13

who:

14

(i)  discovers evidence of suspected sexual abuse of

15

a minor as defined under 23 Pa.C.S § 6303 (relating to

16

definitions) or suspected prohibited sexual acts

17

involving a minor; and

18

(ii)  fails to report the same to the Pennsylvania

19

State Police;

commits a summary offense and shall be sentenced to pay a

2

fine of not less than $50 for a first offense and not less

3

than $150 for subsequent offenses.

4

(2)  Any employer who employs commercial film or

5

photographic print processors and who fails to inform such

6

employees of their required reporting under this subsection

7

commits a summary offense and shall be sentenced to pay a

8

fine of not less than $300.

Section 2.  This act shall take effect in 60 days.
