AN ACT

Amending the act of November 10, 1999 (P.L.491, No.45), entitled

2

"An act establishing a uniform construction code; imposing

3

powers and duties on municipalities and the Department of

4

Labor and Industry; providing for enforcement; imposing

5

penalties; and making repeals," further providing for

6

application.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

9

Section 1.  Section 104(b) of the act of November 10, 1999

10

(P.L.491, No.45), known as the Pennsylvania Construction Code

11

Act, is amended by adding a paragraph to read:

Section 104.  Application.

(b)  Exclusions.--This act shall not apply to:

(9)  Structures which are all of the following:

17

(i)  Used for the direct, seasonal sale of

 


1

agricultural, horticultural and food products.

2

(ii)  Open on at least one side.

3

(iii)  Operated by a farmer whose products make up

4

not less than 50% of the commodities being sold.

5

(iv)  Less than 1,000 square feet and temporary in

6

nature if not located on a farmer’s property.

7

In this paragraph, the term "farmer" shall include members of

8

a  farmer's immediate family, an employee or a person

9

authorized in writing to operate the stand on behalf of the

10

farmer.

Section 2.  This act shall take effect in 60 days.
