AN ACT

Providing for award of attorney fees and costs in certain zoning

2

appeals in cities of the first class.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

Section 1.  Attorney fees and costs.

(a)  General rule.--Subject to the provisions of subsection

7

(b), the prevailing party in an appeal to a court of common

8

pleas from a decision of a zoning board of adjustment in a city

9

of the first class shall be awarded a reasonable attorney fee in

10

an amount to be determined by the court, together with costs,

11

which award shall be paid by the city of the first class.

(b)  Double award.--If the court determines that the zoning

13

board of adjustment acted with gross negligence, in bad faith or

14

with malice in making its decision, the award shall be twice the

15

amount of the reasonable attorney fees and costs.

Section 2.  Effective date.

This act shall take effect in 60 days.
