AN ACT

Providing for broadcast employee contracts; and providing for

2

enforcement.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

5

Section 1.  Short title.

6

This act shall be known and shall be cited as the Broadcast

7

Employment Free Market Act.

8

Section 2.  Definitions.

9

The following words and phrases when used in this act shall

10

have the meanings given to them in this section unless the

11

context clearly indicates otherwise:

12

"Broadcast employee."  An employee of a broadcast industry

13

employer, excluding sales and management employees.

14

"Broadcast industry employer."  A television station and

15

network, radio station and network and cable station and network

16

and any associated broadcast entity.

Section 3.  Prohibitions.

No broadcast industry employer may require, in any employment

2

contract, that a broadcast employee or prospective broadcast

3

employee:

4

(1)  Refrain from obtaining employment in a specified

5

geographic area for a specific period of time after

6

termination of employment with that broadcast industry

7

employer.

(2)  Disclose the terms of an offer of employment from

9

any other broadcast industry employer following the

10

expiration of the term of the employment contract.

11

Section 4.  Contract void and unenforceable.

12

A contract that contains a provision prohibited under section

13

3 shall be void and unenforceable with respect to the provision.

14

Section 5.  Violations.

15

Any person who violates the provisions of this act shall be

16

liable for attorney fees and court costs of the broadcast

17

employee in an action relating to the enforceability of an

18

employment contract between a broadcast employee and broadcast

19

industry employer.

20

Section 6.  Applicability.

21

This act shall apply to contracts entered into on or after

22

the effective date of this section.

Section 7.  Effective date.

24

This act shall take effect in 90 days.
