A SUPPLEMENT
To the act of December 8, 1982 (P.L.848, No.235), entitled "An
act providing for the adoption of capital projects related to
the repair, rehabilitation or replacement of highway bridges
to be financed from current revenue or by the incurring of
debt and capital projects related to highway and safety
improvement projects to be financed from current revenue of
the Motor License Fund," itemizing additional State and local
bridge projects.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Highway-
Railroad and Highway Bridge Capital Budget Supplemental Act for
2011-2012.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Capital project." A capital project as defined in section
302 of the act of February 9, 1999 (P.L.1, No.1), known as the
Capital Facilities Debt Enabling Act, and shall include a county
or municipal bridge rehabilitation, replacement or improvement
project as set forth in this act.
"Department." The Department of Transportation of the
Commonwealth.
"Secretary." The Secretary of Transportation of the
Commonwealth.
Section 3. Total authorization for bridge projects.
(a) Total projects.--The total authorization for the costs
of the projects itemized pursuant to this act and to be financed
from current revenue or by the incurring of debt shall be
$681,510,000.
(b) State projects.--The authorization for capital projects
in the category of highway bridge projects and forestry and
State park bridge projects to be constructed by the Department
of Transportation, its successors or assigns, and to be financed
by the incurring of debt or from current revenue, itemized in
this act under the category of State bridges, shall be
$571,471,000.
(c) Non-State projects.--The authorization for non-State
highway bridge projects to be constructed by municipalities and
to be financed in part with grants not exceeding 80% of the non-
Federal share of the costs made to the local government
municipalities by the department from current revenues itemized
in this act under the category of local bridges, shall be
$110,039,000.
Section 4. Itemization of bridge projects.
The individual capital projects in the category of highway
projects to be constructed by the Department of Transportation,
its successors or assigns, and to be financed from current
revenue or by the incurring of debt are hereby itemized,

together with their estimated financial costs, in the following

Section 72. Miscellaneous.
(1) (Reserved).
Section 73. Limitation on expenditure of funds.
The following shall apply:
(1) Any moneys derived from the incurring of debt shall
be used solely for effecting the rehabilitation, replacement
or removal of bridges located on State highways. All other
bridge rehabilitation, replacement or removal shall be
financed from current revenue.
(2) Notwithstanding any law to the contrary, the
projects itemized in the act of December 8, 1982 (P.L.848,
No.235), known as the Highway-Railroad and Highway Bridge

Capital Budget Act for 1982-1983, may be financed from
current revenue.
Section 74. Debt authorization.
The Governor, Auditor General and State Treasurer are hereby
authorized and directed to borrow from time to time, in addition
to any authorization heretofore or hereafter enacted, on the
credit of the Commonwealth, subject to the limitations provided
in the current capital budget, money not exceeding in the
aggregate the sum of $571,471,000 as may be found necessary to
carry out the acquisition and construction of the State projects
specifically itemized in this act.
Section 75. Issue of bonds.
The indebtedness authorized in this act shall be incurred
from time to time and shall be evidenced by one or more series
of general obligation bonds of the Commonwealth in such
aggregate principal amount for each series as the Governor,
Auditor General and State Treasurer shall determine, but the
latest stated maturity date shall not exceed 30 years from the
date of the bond first issued for each series.
Section 76. Estimated useful life of projects.
The General Assembly states the estimated useful life of the
projects itemized in this act as 30 years.
Section 77. Appropriation.
The net proceeds of the sale of the obligations authorized in
this act are hereby appropriated from the Capital Facilities
Fund to the department in the maximum amount of $571,471,000 to
be used by it exclusively to defray the financial costs of the
State projects specifically itemized in this capital budget.
After reserving or paying the expenses of the sale of the
obligation, the State Treasurer shall pay out to the department

the moneys as required and certified by it to be legally due and
payable.
Section 78. Federal funds.
In addition to those funds appropriated in section 77, all
moneys received from the Federal Government for the public
improvement projects specifically itemized in this act are also
hereby appropriated for those projects.
Section 79. Allocation of funds.
(a) General rule.--Whenever the department or the Department
of Conservation and Natural Resources determines that the full
estimated financial costs of the projects itemized in this act
are not necessary for the proper design, acquisition or
construction of such projects, the excess funds no longer
required may be allocated by the department or the Department of
Conservation and Natural Resources to increase the estimated
costs of any one or more of the projects specifically itemized
in a capital budget.
(b) Reimbursement of municipal expenditures.--Moneys raised
or expended by municipalities after the effective date of this
act, in anticipation of receipt of funds authorized for projects
itemized by this act, may be reimbursable to those
municipalities.
Section 80. Policy on jobs and materials.
(a) Jobs.--It is the declared policy of the Commonwealth
that the construction projects authorized in this act be used,
to the greatest extent possible, to provide for the creation of
jobs and the rehiring of the unemployed in this Commonwealth. In
order to reach this goal, firms with Commonwealth-based
facilities shall be actively solicited to make bids on contracts
to furnish products and materials, including, but not limited

to, steel and steel products, to be used in these projects.
(b) Materials.--Every contract document entered into to
undertake a project contained in this act shall provide that any
steel or other products to be used or supplied in the
performance of this contract shall be required to be
manufactured by plants in the United States unless the secretary
determines, on a contract by contract basis, that certain
required products are not produced in the United States in
sufficient quantities to meet the requirements of the contract.
Such a determination and the reasons therefor shall be published
in the Pennsylvania Bulletin. Decisions made under this
subsection shall not be inconsistent with the general provisions
of the act of March 3, 1978 (P.L.6, No.3), known as the Steel
Products Procurement Act.
(c) Minorities and women.--It is also the declared policy of
the Commonwealth to require and encourage substantial
participation by minorities and women in the construction
projects authorized by this act.
Section 81. Payment of capital debt service.
The repayment of any debt incurred pursuant to this act shall
be made from the account and such repayment shall have first
claim on the revenues of the account.
Section 82. Authorization and debt cumulation.
The additional authorization and debt allowance provided for
in this act shall be added to the total authorizations and debt
incurred pursuant to the act of December 8, 1982 (P.L.848,
No.235), known as the Highway-Railroad and Highway Bridge
Capital Budget Act for 1982-1983, as amended and supplemented.
Section 83. Editorial changes.
In editing and preparing this act for printing following the

final enactment, the Legislative Reference Bureau shall insert
or revise letters or numbers for projects where the letters or
numbers are missing or require revision. The bureau shall also
revise the total monetary amounts for the total authorization,
debt authorization, appropriations and departmental totals as
necessary to agree with the total monetary amounts of the
projects.
Section 84. Effective date.
This act shall take effect immediately.
