| AN ACT |
| |
1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, further providing for |
3 | form of permanent recordation and for copies of destroyed |
4 | records. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Sections 4323 and 4324 of Title 42 of the |
8 | Pennsylvania Consolidated Statutes are amended to read: |
9 | § 4323. Form of [permanent] recordation. |
10 | (a) In general.--Records may be reproduced in accordance | <-- |
11 | with subsection (c). |
12 | (b) Records of permanent value.--[Records which are | <-- |
13 | classified as records of permanent value shall, prior to |
14 | destruction or other removal from the office of the person |
15 | having custody thereof, be processed in conformity with general |
16 | rules so that they may be reproduced [by any photostatic, | <-- |
17 | photographic, microphotographic, microfilm, video tape, magnetic |
18 | tape, or other mechanical process which produces a clear, |

1 | accurate and permanent copy, microcopy or reproduction of the |
2 | original, in accordance with standards not less than those |
3 | approved for permanent records by the National Bureau of |
4 | Standards.] in accordance with subsection (c). | <-- |
5 | (c) Means of reproduction.--Any photostatic, photographic, |
6 | microphotographic, microfilm, microcard, miniature photographic, |
7 | optical, electronic or other process, analog or digital, which |
8 | accurately reproduces the original and forms secure and |
9 | unalterable copies for recording, storing and reproducing the |
10 | original in accordance with standards, policies and procedures |
11 | for the creation, maintenance, transmission or reproduction of |
12 | images of records approved by the governing authority may be |
13 | utilized for reproducing records as authorized in accordance |
14 | with this subchapter. |
15 | (a) In general.--Records may be reproduced in accordance | <-- |
16 | with subsection (c). |
17 | (b) Records of permanent value.--Records which are |
18 | classified as records of permanent value may be reproduced in |
19 | accordance with subsection (c) provided that if the original |
20 | record is being destroyed after reproduction: |
21 | (1) the reproduction format shall be human readable; or |
22 | (2) if the reproduction format is electronic or |
23 | otherwise not human readable, the governing authority, in |
24 | consultation with the County Records Committee, shall create |
25 | and apply standards, policies and procedures for the |
26 | creation, maintenance, backup, migration and transmission of |
27 | permanent records in that format. |
28 | (c) Means of reproduction.--Any photostatic, photographic, |
29 | micrographic, microfilm, microcard, miniature photographic, |
30 | optical, electronic or other process, analog or digital, which |

1 | accurately reproduces the original and forms secure and |
2 | unalterable copies for recording may be utilized for reproducing |
3 | records as authorized in accordance with this subchapter. |
4 | (d) Documents previously recorded, copied or recopied.-- Any |
5 | document within the scope of this section and which previously |
6 | has been recorded, copied or recopied also may be reproduced by |
7 | processes authorized by this section. |
8 | § 4324. Copies of destroyed records. |
9 | [The photostatic, photographic, microphotographic, |
10 | microfilmed or otherwise reproduced] A copy of any record |
11 | destroyed or disposed of as authorized pursuant to this |
12 | subchapter, or a certified copy thereof, if produced in |
13 | accordance with section 4323 (relating to form of recordation) |
14 | shall be admissible in evidence in any matter, and shall have |
15 | the same force and effect as though the original record had been |
16 | produced and proved. It shall be the duty of the person who |
17 | would have had custody of the original record, had it not been |
18 | destroyed pursuant to law, to prepare enlarged, typed or |
19 | photographic copies of such reproduced records whenever their |
20 | production is required. |
21 | Section 2. This act shall take effect immediately. |
