AN ACT

Amending the act of August 4, 1959 (P.L.587, No.195), entitled,

2

as amended, "An act creating and establishing the Legislative

3

Budget and Finance Committee; providing for its membership;

4

prescribing its powers, functions and duties; providing for

5

the appointment of an executive director and other personnel,

6

and making an appropriation," further providing for title of

7

act; adding definitions; changing the name of the committee;

8

further providing for powers and duties of committee;

9

providing for implementation; and making editorial changes.

The General Assembly of the Commonwealth of Pennsylvania

11

hereby enacts as follows:

12

Section 1.  The title of the act of August 4, 1959 (P.L.587,

13

No.195), entitled "An act creating and establishing the

14

Legislative Budget and Finance Committee; providing for its

15

membership; prescribing its powers, functions and duties;

16

providing for the appointment of an executive director and other

17

personnel, and making an appropriation," amended September 20,

18

1961 (P.L.1521, No.645), is amended to read:

19

AN ACT

20

Creating and establishing the [Legislative Budget and Finance

21

Committee] Independent Fiscal Office providing for its

22

membership; prescribing its powers, functions and duties; and

providing for the appointment of an executive director and

2

other personnel[, and making an appropriation].

3

Section 2.  Section 1 of the act is repealed:

4

[Section 1.  There is hereby created the Legislative Budget

5

and Finance Committee which shall consist of the President pro

6

tempore of the Senate and five other members of the Senate, the

7

Speaker of the House of Representatives and five other members

8

of the House. The President pro tempore of the Senate shall

9

appoint the Majority Leader of the Senate, the Minority Leader

10

of the Senate and three additional members of the Senate. Two of

11

the three additional members shall be members of the Minority

12

party. The President pro tempore of the Senate, the Majority

13

Leader and the Minority Leader may designate other members of

14

the Senate to be appointed in their stead. The Speaker of the

15

House of Representatives shall appoint the Majority Leader of

16

the House of Representatives, the Minority Leader of the House

17

of Representatives and three additional members of the House.

18

Two of the three additional members shall be members of the

19

Minority Party. The Speaker of the House, the Majority Leader

20

and the Minority Leader may designate other members of the House

21

to be appointed in their stead. Members of the committee shall

22

be appointed or reappointed during each regular session of the

23

General Assembly, and shall continue as members until the first

24

Tuesday in January of the next odd-numbered year and until their

25

respective successors shall be appointed, provided they continue

26

to be members of the Senate or the House of Representatives. The

27

term of office of such committee members as shall not continue

28

to be members of the Senate or the House of Representatives

29

shall cease upon the convening of the next regular session of

30

the Legislature after their appointment. The committee has a

continuing existence and may meet and conduct its business at

2

any place within the Commonwealth during the sessions of

3

Legislature or any recess thereof and in the interim between

4

sessions.]

Section 3.  The act is amended by adding sections to read:

6

Section 1.1.  Short title.

7

This act shall be known and may be cited as the Independent

8

Fiscal Office Act.

9

Section 1.2.  Definitions.

10

The following words and phrases when used in this act shall

11

have the meanings given to them in this section unless the

12

context clearly indicates otherwise:

13

"Committee."  The committee established by this act.

14

"Executive director."  The director of the Independent Fiscal

15

Office.

16

"Office."  The Independent Fiscal Office established by this

17

act.

18

Section 1.3.  Independent Fiscal Office.

19

The Independent Fiscal Office is established and shall be

20

overseen by a committee consisting of the President pro tempore

21

of the Senate and five other members of the Senate, the Speaker

22

of the House of Representatives and five other members of the

23

House of Representatives. The President pro tempore of the

24

Senate shall appoint the Majority Leader of the Senate, the

25

Minority Leader of the Senate and three additional members of

26

the Senate. Two of the three additional members shall be members

27

of the minority party. The President pro tempore of the Senate,

28

the Majority Leader of the Senate and the Minority Leader of the

29

Senate may designate other members of the Senate to be appointed

30

in their stead. The Speaker of the House of Representatives

shall appoint the Majority Leader of the House of

Representatives, the Minority Leader of the House of

3

Representatives and three additional members of the House of

4

Representatives. Two of the three additional members shall be

5

members of the minority party. The Speaker of the House of the

6

Representatives, the Majority Leader of the Representatives and

7

the Minority Leader of the Representatives may designate other

8

members of the House of the Representatives to be appointed in

9

their stead. Members of the committee shall be appointed or

10

reappointed during each regular session of the General Assembly,

11

and shall continue as members until the first Tuesday in January

12

of the next odd-numbered year and until their respective

13

successors shall be appointed, provided they continue to be

14

members of the Senate or the House of Representatives. The term

15

of office of such committee members as shall not continue to be

16

members of the Senate or the House of Representatives shall

17

cease upon the convening of the next regular session of the

18

Legislature after their appointment. The committee has a

19

continuing existence and may meet and conduct its business at

20

any place within this Commonwealth during the sessions of

21

Legislature or any recess thereof and in the interim between

22

sessions.

Section 4.  Section 2 of the act is amended to read:

24

Section 2.  Basic functions of committee.

25

The committee shall have the power and duty to appoint its

26

own chairman, vice-chairman and other officers, to make rules

27

and regulations governing its proceedings and [to perform either

28

through the Legislative Budget and Finance Committee, or through

29

subcommittees of the Legislative Budget and Finance Committee,]

30

those of the office, in order to ensure that the office performs

all of its duties and functions relating to the study of the

2

revenues, expenditures and fiscal problems of the Commonwealth,

3

its officers, boards, committees, commissions, institutions and

4

other State agencies.

Section 5.  The act is amended by adding sections to read:

6

Section 2.1.  Executive director.

7

The committee shall appoint an executive director for the

8

office and shall fix the executive director's compensation. The

9

executive director shall be the chief executive officer of the

10

office and shall assist the committee in the performance of its

11

duties. The executive director, by continuous review of

12

Commonwealth expenditures, revenues and analysis of the budget

13

shall ascertain the facts, compare cost, workload and other

14

data, and the executive director shall make recommendations

15

concerning the Commonwealth's budget and revenue, including the

16

revenue of the departments, boards, commissions and agencies of

17

the Commonwealth.

18

Section 2.2.  Personnel.

19

The executive director, with the approval of the committee,

20

is authorized to employ other personnel to perform the duties of

21

the office. Compensation shall be fixed by the director with the

22

approval of the committee. The director shall have such other

23

duties as shall be assigned to him by the committee or by law.

24

Section 6.  Section 3 of the act, amended September 20, 1961

25

(P.L.1521, No.645), is amended to read:

26

Section 3.  Powers and duties of office.

27

The [committee] office shall have the following powers and

28

duties:

29

[(1)  The committee shall have power to request, receive,

30

review, examine, study, ascertain and compare fiscal information

concerning the budget, the revenues and expenditures of the

2

Commonwealth and to make recommendations to the Legislature,

3

when found advisable, directed to the elimination of unnecessary

4

expenditures and to the promotion of economy in the government

5

of the Commonwealth.]

6

(1.1)  To provide an assessment of the Commonwealth's current

7

fiscal condition and a projection of what the fiscal condition

8

will be during the next five years, by November 15 of each year.

9

The assessment shall take into account the state of the economy,

10

demographics, revenues and expenditures.

11

(1.2)  To submit a revenue estimate for the next fiscal year

12

to the Governor, the Appropriations Committee of the Senate and

13

the Appropriations Committee of the House of Representatives by

14

the fifteenth of February of each year. The estimate shall

15

include an explanation of the method by which it was determined

16

and shall state both Federal and Commonwealth revenues

17

anticipated for the next fiscal year.

18

(1.3)  To submit an updated revenue estimate for the next

19

fiscal year to the Governor, the Appropriations Committee of the

20

Senate and the Appropriations Committee of the House of

21

Representatives no later than June 15 of each year.

22

(1.4)  To develop and use econometric models to annually

23

forecast Commonwealth revenues and to update the models. The

24

office shall make the equations of a model and any historic

25

databases related to the model available to the Appropriations

26

Committee of the Senate and the Appropriations Committee of the

27

House of Representatives.

28

(1.5)  To provide an analysis of the executive budget,

29

including budgetary projections, economic outlook, economic

30

impact and an analysis of all related tax and revenue proposals.

The budget analysis may include performance recommendations to

2

secure greater efficiency and economy.

3

(1.6)  To request, receive, review, examine, study, ascertain

4

and compare fiscal information concerning the budget, the

5

revenues and the expenditures of the Commonwealth.

6

(2)  To make current examination and, when pertinent, reports

7

concerning the current condition of all [State] Commonwealth 

8

funds, appropriations and other moneys, whether or not such

9

appropriations are being currently expended for the purposes and

10

within the statutory restrictions provided by the [Legislature]

11

General Assembly, and concerning the current availability of

12

revenue to meet expenditures under appropriations.

13

(3)  [The committee shall] To report to the General Assembly

14

when they are in session, the Governor and the Auditor General,

15

when it appears that any appropriation is being expended for

16

purposes other than the purposes for which the appropriation was

17

intended, or if it appears that any statutory restrictions or

18

provisions are being violated.

19

(4)  [The committee shall] To make reports, from time to

20

time, to the members of the [Legislature] General Assembly and,

21

upon request, to the standing committees of the Senate and House

22

of Representatives with respect to any of its findings or

23

recommendations of a fiscal nature. [It shall keep complete

24

minutes of its meetings. The committee shall make and distribute

25

its final report to the members of the ensuing Legislature not

26

later than ten days after the convening of the regular session

27

of the Legislature.]

(5)  [The committee may] To issue subpoenas, under the hand

29

and seal of the [chairman] executive director, to compel the

30

attendance of witnesses and the production of any papers, books,

accounts, documents and testimony touching matters of a fiscal

2

nature properly being inquired into by the [committee] office,

3

to administer oaths, and to cause the deposition of witnesses,

4

either residing within or without [the State] this Commonwealth,

5

to be taken in the manner prescribed by laws for taking

6

depositions in civil actions.

7

(5.1)  To establish an Internet website.

8

[(6)  Any person who wilfully neglects or refuses to comply

9

with any subpoena issued in behalf of the committee, or refuses

10

to testify to any matters regarding which he may be lawfully

11

interrogated, shall be subject to the penalties provided by the

12

laws of the Commonwealth in such cases.

13

(7)  Each witness who appears before the committee by its

14

order, other than an officer or employe of the Commonwealth,

15

shall receive for his attendance the fees and mileage provided

16

for witnesses in civil cases in courts of record, which shall be

17

audited and paid out of the funds of the committee upon the

18

presentation of proper vouchers signed by such witness and

19

approved by the chairman or vice-chairman of the committee.

20

(8)  The Legislative Budget and Finance Committee is

21

authorized to appoint an executive director, and to fix his

22

compensation, who shall be the chief executive officer of the

23

committee and assist in its duties, and shall compile

24

information for the committee. The committee is authorized to

25

select and employ other personnel that it may deem necessary in

26

the performance of its duties, and the compensation and salaries

27

shall be fixed by the Legislative Budget and Finance Committee.]

28

Section 7.  The act is amended by adding sections to read:

29

Section 3.1.  Implementation.

30

The duties of the office under section 3(1.1), (1.2), (1.3),

(1.4) and (1.5) shall not commence until the committee

2

determines, by majority vote, that there are sufficient funds

3

appropriated or made available to the office for payment of the

4

costs to perform the duties under section 3(1.1), (1.2), (1.3),

5

(1.4) and (1.5).

Section 3.2.  Enforcement of subpoenas.

7

Any person who wilfully neglects or refuses to comply with

8

any subpoena issued on behalf of the office, or who refuses to

9

testify to any matters regarding which he may be lawfully

10

interrogated, shall be subject to the penalties provided by the

11

laws of the Commonwealth in such cases.

12

Section 3.3.  Witnesses.

13

Each witness who appears before the office by its order,

14

other than an officer or employee of the Commonwealth, shall

15

receive for the witness' attendance the fees and mileage

16

provided for witnesses in civil cases in courts of record, which

17

shall be audited and paid out of the funds of the office upon

18

the presentation of proper vouchers signed by the witness and

19

approved by the executive director.

Section 8.  Section 4 of the act, amended September 20, 1961

21

(P.L.1521, No.645), is repealed:

22

[Section 4.  The duties of the executive director shall be as

23

follows:

24

(1)  By continuous review of State expenditures, revenues and

25

analysis of budget to ascertain the facts, compare cost,

26

workload and other data, and make recommendations concerning the

27

State's budget and revenue of the departments, boards,

28

commissions and agencies of the Commonwealth.

29

(2)  Such other duties as shall be assigned to him by the

30

Legislative Budget and Finance Committee.]

Section 9.  Sections 5 and 6 of the act are amended to read:

Section 5.  Reimbursement of expenses.

3

The members of the committee shall serve without compensation

4

but shall be reimbursed for their expenses incurred while

5

attending sessions of the committee or meetings of any

6

subcommittee of the committee, or while engaged on other

7

committee business authorized by the committee, and in going to

8

and coming from meetings of the committee or its subcommittees

9

or for travel and other committee business when authorized by

10

the committee.

11

Section 6.  Opportunity to comment.

12

Before any written report is made by the [committee] office,

13

the department, officer or agency of the government involved

14

[therein] in the report shall be afforded an opportunity to

15

comment[,] and [said] the comments shall be attached to [said]

16

the report.

17

Section 10.  Section 7 of the act, amended September 20, 1961

18

(P.L.1521, No.645), is repealed:

19

[Section 7.  The sum of two hundred thousand dollars

20

($200,000), or as much thereof as may be necessary, is hereby

21

specifically appropriated to the Legislative Budget and Finance

22

Committee to pay the expenses of the members of the committee

23

and for the salary or compensation of executive director,

24

clerical and other hire and incidental expenses.]

25

Section 11.  Section 8 of the act is amended to read:

26

Section 8.  Effective date.

27

This act shall take effect [the day following sine die

28

adjournment of the present session of the General Assembly]

29

immediately.

30

Section 12.  This act shall take effect in 60 days.
