AN ACT

Amending the act of March 21, 1986 (P.L.64, No.19), entitled "An

2

act imposing a moratorium on the operation of private prisons

3

and creating a legislative task force to conduct an

4

investigation of the feasibility of private prisons," further

5

providing for a moratorium and for continued operation.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

Section 1.  Sections 3 and 5 of the act of March 21, 1986

9

(P.L.64, No.19), known as the Private Prison Moratorium and

10

Study Act, are amended to read:

Section 3.  Moratorium.

12

(a)  Prohibition.--[On and after the effective date of this

13

act, no] No private correctional facility shall be operated

14

within this Commonwealth.

15

[(b)  End of moratorium.--The prohibition contained herein

16

shall remain in effect until June 30, 1987.]

(c)  Exception.--Nothing in this section shall apply to

18

private contractors for security services as defined in this

19

act.

Section 5.  Continued operation.

(a)  General rule.--Nothing in this act shall prevent the

3

continued operation of any private correctional facility which

4

was in operation [during 1985.]:

5

(1)  during 1985; or

6

(2)  on the effective date of this paragraph.

(b)  Restrictions.--Incarceration in a private correctional

8

facility shall be limited to the following:

9

(1)  Inmates sentenced for summary offenses or offenses

10

pursuant to 75 Pa.C.S. § 3731 (relating to driving under

11

influence of alcohol or controlled substance).

12

(2)  Prison inmates that are not Federal.

13

(3)  Prison inmates that are not from a state other than

14

Pennsylvania.

15

Section 2.  This act shall take effect in 60 days.
