SUMMARY The following summary is not prepared by the sponsors of the measure and is not a part of the body thereof subject to consideration by the Legislative Assembly. It is an editor's brief statement of the essential features of the measure as introduced. Requires Legislative Assembly to provide funding for statutes created or amended by initiative petition. Provides that if funding measure is referred by people and defeated, Legislative Assembly need not fund initiated measure. Specifies that if funding measure is referred by people and defeated, Legislative Assembly must again provide funding at next regular session following referendum election. Declares emergency, effective on passage. A BILL FOR AN ACT Relating to funding initiated laws; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. { + (1) The Legislative Assembly shall enact legislation that supplies adequate funding for implementation of any state initiative measure approved by the people that creates or amends statutory law and that requires funding in an amount that exceeds $100,000 for a biennium. Funding legislation shall be enacted at the first regular session of the Legislative Assembly that begins after the state initiative measure is approved by the people. (2) If legislation enacted by the Legislative Assembly pursuant to subsection (1) or (3) of this section is referred by petition to the people for their approval or rejection under section 1 (3), Article IV of the Oregon Constitution, and the people reject the legislation, the Legislative Assembly is not obligated to fund implementation of the changes to law made by the state initiative measure. (3) If the people reject the legislation under subsection (2) of this section, the Legislative Assembly shall enact legislation that supplies adequate funding for the implementation of the state initiative measure at the first regular session of the Legislative Assembly that begins after the election conducted under subsection (2) of this section. Subsection (2) of this section applies to legislation enacted under this subsection. (4) If legislation enacted by the Legislative Assembly pursuant to subsection (1) or (3) of this section is referred to the people for their approval or rejection under section 1 (3), Article IV of the Oregon Constitution, the initiative measure is not required to be implemented during the period beginning on the deadline for filing a referendum petition on the legislation and ending on the date the Governor proclaims the results of the election on the referendum measure under ORS 254.555. + } SECTION 2. { + This 2011 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2011 Act takes effect on its passage. + } ----------
