                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Directs State Board of Education to adopt statewide performance
standards to determine effectiveness of teachers and
administrators.
  Declares emergency, effective July 1, 2011.

                        A BILL FOR AN ACT
Relating to performance standards for educators; and declaring an
  emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2011 Act is added to and made
a part of ORS 342.805 to 342.937. + }
  SECTION 2.  { + (1) The State Board of Education, in
consultation with the Teacher Standards and Practices Commission,
shall adopt statewide performance standards to assist school
districts in determining the effectiveness of teachers and
administrators for the purpose of making employment decisions,
including continued employment, compensation and career
advancement.
  (2) The performance standards adopted under this section must:
  (a) Take into consideration multiple measures of student,
school and school district performance data, which:
  (A) Must include student academic growth data that is both
formative and summative; and
  (B) May include graduation rates, student attendance rates,
scores on nationally normed assessments and other indicators of
student proficiency;
  (b) Be research-based;
  (c) Be separately developed for teachers and administrators;
and
  (d) Be able to be customized for each school district.
  (3) A school district board must include the performance
standards adopted under this section for all evaluations of
teachers and administrators of the school district. + }
  SECTION 3.  { + (1) Section 2 of this 2011 Act becomes
operative on July 1, 2013.

  (2) The requirements of section 2 (3) of this 2011 Act apply to
all evaluations of teachers and administrators occurring on or
after July 1, 2013. + }
  SECTION 4.  { + (1) For the purpose of adopting the statewide
performance standards required by section 2 of this 2011 Act, the
State Board of Education and the Teacher Standards and Practices
Commission shall develop recommendations for the standards no
later than January 1, 2012.
  (2) No later than January 1, 2013, the State Board of Education
shall adopt statewide performance standards that comply with the
requirements described in section 2 of this 2011 Act.
  (3) The State Board of Education shall adopt the standards as
required by subsection (2) of this section:
  (a) In consultation with the Teacher Standards and Practices
Commission; and
  (b) After receiving the input of teachers, administrators,
professional organizations for teachers and administrators and
any other entity that the state board or commission determines
has an interest or expertise related to the standards. + }
  SECTION 5.  { + This 2011 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2011 Act takes effect July 1,
2011. + }
