CHAPTER ................
AN ACT
Relating to Department of Corrections fees for service of
documents; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) The Department of Corrections may charge
and collect fees for serving process and other documents on
inmates of Department of Corrections institutions as defined in
ORS 421.005 and officials and employees of the department.
(2) Before charging fees pursuant to subsection (1) of this
section, the department shall adopt rules establishing a fee
schedule. Fees charged by the department may not exceed fees
collected by sheriffs for service of process in civil actions,
suits and proceedings pursuant to ORS 21.410. + }
SECTION 2. { + This 2011 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2011 Act takes effect on its
passage. + }
